Casey Gerry Reed & Schenk recently won a $261,000 award for an El Cajon resident who slipped and fell in McDonald's restaurant in the city’s Parkway Plaza mall. Margaret Wahlen, 48, needed four surgeries -- one on her shoulder and three on her right knee -- and 123 physical therapy sessions after the fall. Attorney Thomas Penfield said the case went to trial after McDonald's and the mall refused to pay his client's medical bills. Wahlen's accident was caused by water that flowed onto the mall’s terrazzo tile, which created a slippery surface at the McDonald's restaurant. "The jury found that Parkway Plaza had not taken the necessary steps to make its flooring more slip resistant, even though it knew terrazzo tile was extremely dangerous when wet," Penfield said. Even after surgery and therapy, Wahlen still has difficulty walking, he said. |
