$590,000 awarded in rare case


A Superior Court jury has awarded the family of a deceased Escondido man $590,000 in connection with a lawsuit against a convalescent hospital that the family said acted in bad faith in failing to provide proper care.

The verdict, returned Thursday, in favor of Grace Lykens, Ruth Spicuzza and Janet Anziano, includes a $500,000 award of punitive damages against Beverly Manor Convalescent Hospital of Escondido.

Lykens is the widow of Aaron Lykens, Spicuzza is his daughter and Anziano is his granddaughter.

For four months in early 1981, Aaron Lykens, 89, stayed in Beverly Manor, where he developed large bed sores over much of his body and lost about one-third of his body weight, said attorney T. Michael Reed.

Lykens died May 28, 1981, in an Escondido hospital, approximately one month after he left Beverly Manor, of congestive heart failure.

In addition to the punitive damages, the jury assessed the convalescent hospital for the family’s emotional distress.
