Woman hit by truck gets $1.6 million


A Superior Court jury has awarded $1.6 million in damages to a Mira Mesa woman severely injured when a truck filled with concrete blocks rolled off a freeway shoulder and crashed into her car.

After a month long trial, the jury deliberated four hours last week before returning its verdict in the trial before Judge Anthony C. Joseph.

The $1,665,031.57 was awarded to the plaintiff, Jayme Annis, 26, who sued over the May 27, 1982, accident.

According to court documents, Annis’ car was struck by a dump truck that had pulled over to the shoulder of an incline on Interstate 805 just north of off-ramps to I-8. Annis’ injuries included fractures to her right arm, collarbone, kneecap and skull. She also received brain damage and was in a coma for several days, the court was told.

John McCormick, the attorney for the concrete firm, had argued in part that Annis could have minimized injuries by wearing a seat belt. Her attorney, T. Michael Reed, contended that the truck driver was negligent for not engaging the parking brake.
