When a  Lexus ES350 sedan sped out of control last summer, killing an off-duty California Highway patrol officer and his family on an East San Diego County highway,   the country never imagined the incident would morph into one of the largest auto recalls in history.

 In fact, in recent months, Toyota has recalled more than eight million vehicle following increasing reports of sudden acceleration.  Experts are  anticipating an avalanche of lawsuits blaming the Japanese auto giant for both deaths and injuries, as well as for the erosion in the resale value in the wake of the recalls. The cost of settling or litigating these lawsuits could amount to $3 billion or more.

 In the first Class Action filed in California State Court regarding the Toyota recalls, Casey Gerry attorneys Frederick Schenk and David S. Casey, Jr. are serving as co-counsel in a lawsuit filed in San Diego Superior Court against Toyota regarding these sudden unintended acceleration recalls.

The State filed case differs from the Federal actions being filed across the country in many significant ways.  This case concerns a “ in value” of Toyota and Lexus vehicles and only concerns Toyota and Lexus vehicles sold and owned by California residents. Lastly, this new class action does not directly concern the underlying defects, such as floor mats, faulty gas pedals or computer software glitches, but directly relates to loss of value to Toyota and Lexus vehicles because of recent recalls.
